These Terms & Conditions apply to organisations and authorised users registering businesses, venues, properties, visitor products, services or other offerings for listing on, or use of, the Ask Destinations platform.
We have written these terms in plain English so they are easier to understand, while still protecting both your business and Ask Destinations.
1. Overview
These Terms & Conditions apply to businesses (“Partners”, “you”) who register to be listed on or use the Ask Destinations platform.
Ask Destinations (“we”, “us”, “our”) provides destination websites, business listings, AI-powered virtual assistants, marketing exposure and related lead generation tools.
“Partner” means the organisation or legal entity responsible for an account and its associated businesses, offerings and destination listings.
By submitting your details, creating a listing, purchasing a listing tier, or using our services, you agree to these Terms.
2. Partner eligibility
By registering, you confirm that:
- you are authorised to represent the business
- your business operates legally
- all information you provide is accurate and up to date
3. Owner and Editor authority
An Organisation Owner is responsible for the organisation’s account, members, billing, subscriptions and acceptance of commercial arrangements.
An Editor may manage business and listing content and submit listings for review but cannot manage billing, subscriptions, organisation ownership or member access.
Users must keep their login credentials secure and must not permit unauthorised access. Actions taken by authorised account users may be treated as actions of the Partner organisation.
4. Your listing and content
You may provide us with business information such as:
- business name and contact details
- descriptions, images, pricing and offers
- website and social media links
- business features, categories and promotional content
You agree that:
- all content you provide is accurate, complete and not misleading
- you do not omit material information that could mislead users
- any claims (including pricing, offers, awards or rankings) are truthful and can be substantiated if required
- you have the right to use and share all content, including images and logos
- your content complies with all applicable advertising and consumer protection laws
You are solely responsible for ensuring your listing does not mislead users through inaccurate, incomplete or unclear information.
We may:
- edit formatting for consistency and clarity
- request clarification or evidence for claims where needed
- remove or amend content that may be misleading or non-compliant
5. How the platform works
Ask Destinations may:
- display your business on destination websites and related digital assets
- feature your business through AI-powered assistants
- include your business in search results, categories, featured placements and curated responses
We do not guarantee:
- any minimum number of leads, clicks, enquiries, bookings or revenue
- placement priority unless this is clearly part of a paid tier or offer
- continuous or uninterrupted platform availability
Where businesses are featured, prioritised or promoted (including paid placements), this may influence visibility within the platform. We aim to present information in a way that is clear and not misleading to users.
Creating an account, submitting a listing or selecting a tier does not guarantee approval, publication, tier activation or promotional placement.
Listings are subject to review. We may approve a listing, request changes or decline it where it does not meet platform, quality, relevance, legal or destination requirements.
Content approval and paid-tier activation are separate decisions. A paid tier is not publicly activated until the applicable payment or separately approved commercial arrangement has become effective.
Before a destination’s public launch, approved Partner data may be used in a restricted, non-public validation environment to test AI responses, data quality and platform behaviour. Inclusion in that environment does not constitute public publication or activation of paid benefits.
6. AI-generated responses
Our platform uses AI to recommend, summarise and describe businesses and services.
AI-generated responses may be influenced by factors such as relevance, user intent, data quality and, where applicable, promotional arrangements or featured placements.
While we aim to present information clearly and fairly, AI responses may summarise or prioritise content and should not be considered a complete or authoritative comparison of all available options.
You acknowledge that:
- AI responses are automated and may reword or summarise your content
- comparisons between businesses (if any) are general in nature and may not include all relevant factors
- users should verify important details directly with businesses
Paid tiers or promotional arrangements may affect eligible placement and visibility, but do not override factual relevance, user intent, data accuracy, safety requirements or legal obligations.
7. Partner responsibilities
You agree to:
- keep your business information current and accurate
- respond to customer enquiries where applicable
- honour offers, pricing and information you have supplied for publication
- comply with all relevant laws, including consumer protection and advertising laws
8. Fair representation and comparisons
Ask Destinations aims to present business information in a fair, balanced and non-misleading way.
Where comparisons between businesses are made (including through AI responses, categories or recommendations), these are based on available data and automated processes and may not represent a complete comparison of all providers.
We do not guarantee that:
- all competitors will be included in comparisons
- comparisons will reflect all relevant features, pricing or factors
Partners must not submit content that unfairly discredits competitors or creates misleading comparisons.
9. Fees and payments
Some listings, upgrades, subscription plans or promotional placements may be paid.
Where fees apply, pricing, features and inclusions will be outlined by Ask Destinations at the time of signup, renewal or upgrade.
Payments may be processed through third-party providers such as Stripe.
Unless otherwise stated or required by law, fees are non-refundable.
We may update pricing, package inclusions or plan structures from time to time with reasonable notice.
Unless expressly stated otherwise, prices are in Australian dollars and exclude GST.
Each destination listing may have its own subscription, price, commencement date and entitlement.
Paid subscription billing ordinarily commences only after listing approval. Where Checkout is completed before the destination’s public launch, billing commences on the disclosed scheduled commencement date. Where Checkout occurs after public launch, billing ordinarily commences immediately.
Completing Checkout does not itself prove that a paid entitlement is active. Activation depends on confirmation of successful payment or another commercial arrangement authorised by Ask Destinations.
Month-to-month and fixed-term price changes, renewals, cancellations, cooling-off periods and refunds are governed by our Refund and Cancellation Policy.
Category Dominant, custom services and manually invoiced arrangements may be subject to separate written commercial terms. Those terms prevail to the extent of any inconsistency.
Eligibility-based pricing and complimentary access
Association-member pricing, community access and other eligibility-based offers are conditional on verification and may be reviewed periodically, including annually.
We may require confirmation from an association, an association membership list, an ABN, incorporation details or other reasonable evidence.
If eligibility expires or cannot be confirmed, the relevant listing may move to an available standard price or tier after reasonable notice and in accordance with any active fixed-term commitment.
Complimentary Get Linked access for eligible community organisations applies only to listings and activities approved under the applicable community-access criteria. Not-for-profit or charitable status does not automatically make every commercial business or listing eligible.
10. Leads and customer relationships
Ask Destinations may refer visitors and users to your business through listings, links, AI responses, contact pathways or other lead-generation features.
You are responsible for:
- managing your customer enquiries and communications
- delivering your own products and services
- setting and honouring your own terms, policies and business processes
We are not responsible for:
- transactions between you and customers
- bookings, cancellations, disputes or refunds
- the quality, suitability or delivery of your goods or services
11. Intellectual property
You retain ownership of your business name, branding and the content you provide.
By submitting content to us, you grant Ask Destinations a non-exclusive, royalty-free licence to use, display, publish, reproduce, adapt and promote that content for the purpose of operating, marketing and improving the platform and related services.
This includes use in listings, AI-generated responses, destination pages, promotional material, internal platform operations and related marketing.
This licence begins when content is submitted and includes its use for review, moderation, restricted pre-launch validation, AI-response testing, publication and platform operation.
12. Platform use restrictions
You must not:
- provide false, misleading or deceptive information
- make misleading comparisons with other businesses or competitors
- upload unlawful, offensive, defamatory or infringing content
- attempt to interfere with platform functionality, security or performance
- misuse the AI assistant, forms, workflows or system features
- use the platform in a way that damages Ask Destinations, other partners or users
13. Suspension or removal
We may suspend or remove your listing, account or access if:
- your information is inaccurate, misleading or outdated
- you breach these Terms
- your business is no longer suitable for the platform
- payment remains overdue after any applicable payment-recovery period, or a paid entitlement has otherwise ended
- required by law, regulation or a third-party provider arrangement
Where reasonable, we will generally aim to notify you first.
An initial payment failure does not activate paid benefits. If a renewal payment fails, an existing paid entitlement may remain available during the applicable seven-day recovery period.
When a paid entitlement ends because of cancellation or terminal payment failure, an otherwise approved listing will ordinarily revert to Get Listed rather than being removed, subject to continued eligibility and compliance with these Terms.
14. Limitation of liability
To the extent permitted by law, Ask Destinations provides the platform and services on an “as is” and “as available” basis.
We are not liable for indirect, incidental or consequential loss, including loss of revenue, business opportunity, goodwill, data or expected benefits.
Nothing in these Terms excludes, restricts or modifies rights that cannot legally be excluded, including rights under Australian Consumer Law where applicable.
15. Indemnity
You agree to indemnify Ask Destinations against claims, losses, damages, liabilities, costs or expenses arising from:
- your business operations
- your products or services
- your content, listings or promotional claims
- your breach of these Terms
16. Privacy
We handle personal information in accordance with our Privacy Policy.
By registering for or using the platform, you agree to our Privacy Policy as updated from time to time.
17. Changes to the platform
We may:
- update the design, structure, features or functionality of the platform
- add, remove or revise services, categories, tools or workflows
- improve AI systems, business rules and data models
We will aim to provide reasonable notice of major changes where practical.
18. Termination
You may request removal of your listing at any time by contacting us.
Requesting removal of a listing does not by itself cancel a subscription or remove payment obligations under an active fixed-term commitment. Subscription cancellation must be completed in accordance with the Refund and Cancellation Policy.
Cancelling a paid subscription does not necessarily remove the underlying approved listing. It may instead revert to Get Listed when the paid entitlement ends.
We may terminate, suspend or restrict access to your listing or related services at our discretion, subject to these Terms and any applicable law.
19. Terms
We may update these Terms from time to time. We will provide reasonable notice of material changes where practical. Changes will not retrospectively alter the agreed price or commitment period of an active fixed-term subscription.
20. Governing law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland and any courts entitled to hear appeals from them.
